Terms of Service

These terms govern your use of Ometra. By creating an account or using the service, you agree to them. Please read them alongside our Privacy Policy, Data Policy, and Data Processing Agreement.

1. The service

Ometra provides privacy-first, cookieless web analytics — including dashboards, goals and revenue tracking, heatmaps, and shareable reports — operated by Ometra Analytics from Ontario, Canada.

2. Your account

You must be at least 16 years old and provide accurate information. You are responsible for activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

  • Use Ometra for anything illegal, or to infringe others' rights
  • Send us data you are not permitted to collect, or use the service to collect sensitive personal data without a lawful basis
  • Attempt to breach, overload, probe, or disrupt our infrastructure, or circumvent usage limits
  • Resell or resupply the service except as expressly permitted (e.g. agency use for your own clients)

You are responsible for your own website's compliance, including any notices or consents your jurisdiction requires for you to install analytics.

4. Your data

You own the analytics data you collect through Ometra. With respect to the personal data of your website's visitors, you are the controller and we are the processor; that relationship is governed by our Data Processing Agreement, and the data itself is described in our Data Policy.

5. Plans, billing, and taxes

Paid plans are billed in advance on a monthly or annual cycle through our Merchant of Record, Lemon Squeezy, who handles payment and applicable taxes. Where a plan offers metered overage, additional events beyond your included volume are billed at the plan's published rate on your next invoice; otherwise collection pauses until your cycle resets. We may change prices with reasonable advance notice; changes take effect on your next renewal.

6. Free tier

We offer a free plan subject to its stated limits. We may change the free tier's limits over time, and we may pause data collection once a free account reaches its cap until the cycle resets.

7. Cancellation and refunds

You can cancel anytime; your plan remains active until the end of the current paid period and does not renew. Except where required by law, payments are non-refundable. Your data remains available to export while your account is active.

8. Availability

We work to keep Ometra reliable and fast, but the service is provided on an “as is” and “as available” basis without an uptime guarantee unless a separate service-level agreement is agreed in writing.

9. Intellectual property

We retain all rights in the Ometra software, brand, and website. You retain all rights in your data. You may not copy, resell, or create derivative works of the service except as permitted by law or these terms.

10. Limitation of liability

To the maximum extent permitted by law, Ometra is not liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify us against claims arising from your use of the service in breach of these terms or applicable law, including claims relating to the data you choose to collect.

12. Suspension and termination

We may suspend or terminate accounts that violate these terms, create security or legal risk, or fail to pay. You may terminate at any time by cancelling and closing your account.

13. Changes to these terms

We may update these terms; we'll post the new version here and update the date above. Material changes will be communicated to account holders, and continued use after changes take effect constitutes acceptance.

14. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You and Ometra submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising out of or relating to these terms or the service.
